February 1, 2010 is approaching. Are you in compliance?
Ontario Regulation 419/05 Phase-In Mandatory Compliance Assessment
On February 1, 2010, more of Ontario Regulation 419/05 will be phased-in. Industries listed in Schedule 4, which includes some of the larger industries such as basic chemical manufacturing, petroleum refining, resin and synthetic rubber manufacturing, ferrous and non-ferrous alloy manufacturing, will be required to demonstrate compliance using advanced atmospheric dispersion models and compliance will be measured against the more stringent point of impingement limits provided in Schedule 3.
All other manufacturers, hospitals, schools, and commercial properties will also be impacted. On February 1, Schedule 2 becomes effective for them. In some cases, the new compliance limits are 99% lower than the previous limits.
On or before February 1, 2010 you must be able to demonstrate compliance with the appropriate Schedule, and if you don’t, there is a duty to report to the Ministry of the Environment.
If you have a Certificate of Approval (CofA air), the assessment can be done quickly and cost effectively. If you don’t have a CofA there is more work involved but it’s not too late.
