O.Reg. 511/09 Amendments to O.Reg.153/04 & Environmental Risk Assessment

This complimentary breakfast session provides a summary of the amendments to O.Reg. 153/04 and how these reforms will affect stakeholders involved in assessment, remediation, development and financing of real estate in Ontario.

Presented by Pinchin Environmental Due Diligence and Remediation staff:

  • Vico Paloschi, Vice President
  • John Goodin, Risk Assessment

The session will also provide a useful introduction to Ontario’s environmental risk assessment process.

Brownfield Regulation

On Dec. 29, 2009, the Ontario Ministry of the Environment (MOE) posted regulatory amendments to O.Reg. 153/04, (also known as the Brownfield Regulation).

Brownfield sites are former industrial or commercial properties, contaminated or derelict from their former use, which have redevelopment potential.

The current Brownfield Regulation (promulgated in 2004) represents an initial attempt by the Ontario Government to reach their environmental and economic objectives to build sustainable communities. The proposed MOE reforms to the Brownfield Regulation are the government’s attempt to tackle some of the current constraints in the legislation preventing full and timely use of these opportunities.

The proposed reforms include:

  • Enhance Record of Site Condition (RSC) Integrity
  • Off-Site liability protection
  • Strengthened soil, sediment and groundwater standards
  • A Streamlined Risk Assessment process

Pinchin will discuss the proposed reforms and how they will affect site assessment, remediation, redevelopment and financing.

Risk Assessment (RA)

You’ve just discovered that, under the proposed reforms, your property exceeds the generic site condition standards and remediation may not be economically feasible or physically possible. All is not lost! Fortunately in Ontario, RA can be used to set higher (risk based) assessment and remediation standards.

Come and find out how the Pinchin RA approach can help you make the right decision on residential, commercial and industrial property!

Risk Assessment Flow Chart

Pinchin will present the basics on:

  • How RA is currently conducted under Ontario Regulation 153/04
  • The proposed Tier II RA model
  • Off-site liability – how this is addressed in a RA
  • Soil vapour intrusion and why it’s important.

Examples from various case studies will be presented.
